E&B Issues Statement Regarding Permits, Project

This statement was issued this afternoon by Michael Finch, vice president of Health Safety & Environment, E&B Natural Resources.

“As part of the environmental site investigation of the City maintenance yard, an E&B Natural Resources contractor conducted additional borings to sample the groundwater. The groundwater sampling was in response to additional information requested by the City for the upcoming environmental review process under the California Environmental Quality Act. On May 7th, the contractor conducted three shallow borings to sample the groundwater. Prior to the sampling, E&B executed a license agreement with the City so that environmental contractor could access the site. We have since learned that a boring permit was not obtained in advance of the samplings. This was rectified as soon as it was brought to our attention and the necessary paperwork was filed with the Department of Public Health on May 13th. The contractor was ordered to submit an application with a $130 fee per boring, submit proof of their contractor license, and make payment in a forthcoming cost recovery and expense billing notice. This was an oversight on E&B's part and we take full responsibility. We believe the sampling was prudent and will provide valuable insight for the upcoming environmental review process.

For background, the initial environmental site assessment was performed in June of 2012 and incorporated into E&B’s Planning Application as Volume 2 Appendix E and F. E&B’s Planning Application includes a Remedial Action Plan for the existing site that would be performed if the project goes forward with full implementation. The results and additional analysis of the groundwater testing will be included in a supplemental report to the Phase 2 Environmental Site Assessment included as part of the E&B Planning Application.
